1. These general Terms & Conditions are applied to the commercial relationship between the customer and Equilibra at the time of a valid order being placed. Any alteration, supplement or other terms of trade require written confirmation and must have been agreed prior to the order being placed.
2. Equilibra must validate payment submitted by the customer before any order can be accepted. Once these details are validated Equilibra will confirm that the order has been accepted by sending an e-mail to the address supplied by the customer. Acceptance of the order constitutes a legally binding contract between the seller (Equilibra) and the customer.
3. Equilibra works in accordance with the UK Data Protection Act, your personal data is retained in order to provide the services requested from us.
4. Payment is due at the time of placing the order.
5. Delivery of your Equilibra order will be made by reputable third party carriers, to the delivery address given at the time of placing the order. Every effort will be made to deliver within the period specified for delivery.
6. All goods remain the property of Equilibra until paid for in full.
Any goods received in error, found to be damaged upon receipt can of course be returned. We must be notified of any goods to be returned within 7 working days of delivery. Items ordered in error must be returned by the purchaser and must be received back unopened as we require the goods returned in the same condition as they were sent. Any refund will be made in the same manner as the original order, less administrative and shipping costs.
7. Should any of these Terms & Conditions be held to be invalid or unenforceable, then the validity and enforceability of the remaining Terms & Conditions shall not be affected.
8. If you have ordered a product that is not available for delivery to your country and have paid by credit card, then we shall cancel the order before shipping and refund the total amount back to your card minus the administration charge of 4.5% which the credit card company subjects us to.
THE DISTANCE SELLING REGULATIONS
The Consumer Protection (Distance Selling) Regulations 2000 (the Regulations) set out minimum requirements for the protection of consumers in respect of distance contracts. A distance contract is one where the supplier and consumer do not come face to face, up to and including the moment at which the transaction is concluded.
The regulations apply to all transactions with consumers who have a close connection with an EU country. This is the case even if the laws of a non-EU country govern the transaction.
The Regulations specify that goods and services must be delivered within 30 days unless otherwise agreed and there are restrictions on the use of unsolicited marketing communications. The Regulations require that before a transaction is concluded, consumers must be provided with certain specific information including:
The identity of the Supplier; A description of the goods or services; The price of the goods and services, including all taxes; Confirmation of the delivery arrangements and delivery costs, where they apply; Arrangements for payment; The right to cancel the order.
